Terms and Conditions

1. The ADHD and Families 31-Day Challenge (“challenge”) is provided to you by Sharon Collon trading as The Functional Family (ABN 22 416 812 267) (“The Functional Family”).
2. Please read these terms and conditions carefully. These terms and conditions form a contract between you and The Functional Family. By accepting these terms and conditions or proceeding with the challenge you acknowledge that you have read and understood these terms and conditions and agree to be bound by them.
3. (No Medical or psychological advice) You agree and acknowledge that:
   a. the challenge has not been written by doctors or psychologists and you will not receive any medical or psychological or other professional advice during the challenge or any advice in relation to any medical or psychological treatment; and
   b. the information and strategies provided as part of the challenge are of a general nature only and may not be suitable for you or your family or your particular circumstances. You are responsible for assessing whether any of the tip, or strategy, method or technique provided by the challenge is suitable for you or your family prior to implementing any tip, strategy, methods or technique you learn or access through the challenge.
4. (Wellbeing) You are responsible for the wellbeing of yourself and your family while undertaking this challenge. If in doubt, you should seek professional advice.
5. (No special skills) All opinions and strategies provided as part of the challenge or on The Functional Family website are based solely on the experiences of The Functional Family founder as a mother of a child diagnosed with ADHD and not on any special or professional skills.
6. (No guarantee of results) The challenge contains tips and strategies that have been tested by and achieved results for The Functional Family founder, however there is no guarantee that you will achieve any particular result.
7. (External Content) From time to time, the Functional Family may provide links to content or resources on other websites not operated by The Functional Family. Such links are provided for informational purposes only and The Functional Family does not warrant the accuracy or completeness of any information or content and will not be liable in any way in relation to the content provided on such third party websites.
8. (Challenge Materials) The challenge materials are made available to you during the challenge for your personal use only. You may not otherwise use, copy or distribute any of the challenge materials. You may not use any of the challenge materials for your financial gain or a commercial purpose. All challenge materials remain the property of The Functional Family or its licensors.
9. (Communications) You agree to be polite and respectful in all your communications (including with other challenge members) on the Facebook group and on any other forum provided by The Functional Family from time to time. You may be blocked from the Facebook group or other forum and your access to the challenge may be suspended with no refund provided in the event that you breach this clause 9. To the extent permitted by law, the Functional Family shall not be liable for any actions of other challenge participants.
10. (Access to Challenge Materials) The challenge materials will be available to you for a total of 12 months after you begin the challenge. After this time, you will no longer have access to the challenge or the challenge materials. You will not be entitled to a refund in the event that you do not complete the challenge during the time period allowed. The Functional Family does not guarantee that your access to the challenge materials or The Functional Family’s website will be uninterrupted or error free or free from viruses or malware. In the event of significant disruption or technical difficulties caused by The Functional Family or its infrastructure which prevent you from accessing or participating in the challenge, The Functional Family will consider giving you a full or partial refund, providing that you have promptly notified The Functional Family of the problem, in any event no later than 30 days after the issue is experienced, and have allowed the Functional Family to fix the problem or resupply the challenge. Under no circumstance will The Functional Family be responsible for problems caused by you or your service providers.
11. (Your feedback) You grant The Functional Family a revocable, worldwide royalty free licence to use, publish and distribute any feedback you provide in relation to the challenge to promote and market the challenge and you warrant that such use of your feedback will not breach the intellectual property rights of any third party.
12. (Privacy) You acknowledge The Functional Family’s privacy policy as published on its website and agree that your personal information may be used in accordance with the policy. The Privacy policy may be changed by The Functional Family from time to time ad changes will be posted to the Functional Family’s website.
13. (Limitation of Liability) To the extent permitted by law, The Functional Family will not be liable to you for any loss or damage you sustain in connection with the challenge, or for any consequential loss or special damages or for any claim or cause of action whatsoever (including for negligence) in connection with the challenge. To the extent such liability cannot be excluded by law, such liability shall be limited to a refund of the challenge fee.
14. (Consumer Law Rights) This contract does not exclude your applicable rights under Australian consumer law.
15. This agreement may only be varied or assigned by agreement of the parties in writing.
16. In the event  that any part of this agreement is unenforceable, void, illegal or invalid, that part shall in the first instance be read down so as to be valid and enforceable, and if such reaching down not possible, it shall be severed from this agreement without affecting the validity or enforceability of any other part of this agreement.
17. This agreement is the entire agreement of the parties in relation to its subject matter.
18. This agreement shall be governed by the laws of the state of New South Wales and the parties unconditionally surrender to the jurisdiction of the courts of the state of New South Wales.
